1. About Us

Maqam Digital (“we”, “us”, “our”) is a web design and development studio operated by Obaid. Our contact details are available on our website.

2. Services

We provide services including website design and development, e-commerce solutions, AI automation, custom software development, website maintenance, consulting, and related digital services.

The scope of work for each project will be defined in a written proposal, quotation, statement of work, or service agreement accepted by the client.

3. Quotations and Acceptance

All quotations are valid for 30 days unless otherwise stated.

A project is deemed accepted once the client confirms acceptance in writing, pays a deposit, or instructs us to commence work.

4. Fees and Payment

Project fees are payable according to the agreed proposal or invoice.

Unless otherwise agreed, project payments are made in milestones:

  • 40% deposit before work commences
  • 40% during development
  • 20% prior to launch or delivery

Monthly maintenance and support plans are billed in advance and may be cancelled with 30 days’ written notice.

We reserve the right to pause work, withhold deliverables, or suspend services for overdue invoices.

5. Client Responsibilities

The client agrees to:

  • Provide content, access credentials, feedback, and approvals in a timely manner.
  • Ensure all materials supplied are accurate and lawful.
  • Hold the necessary rights, licences, and permissions for any content, images, trademarks, or intellectual property provided to us.

Project timelines may be extended where delays are caused by the client.

6. Revisions and Scope Changes

Projects include the number of revisions specified in the proposal.

Any request outside the agreed scope may require a separate quotation and additional fees. No additional work will commence without client approval.

7. Intellectual Property

Upon receipt of full payment, ownership of the final approved website, design assets, and custom-developed code created specifically for the client will transfer to the client.

We retain ownership of:

  • Pre-existing frameworks, tools, templates, processes, and proprietary systems.
  • Third-party software, plugins, themes, APIs, and libraries, which remain subject to their respective licences.

Unless otherwise agreed in writing, we may display completed work within our portfolio, marketing materials, and case studies.

8. Third-Party Services

Projects may rely on third-party providers, including hosting companies, domain registrars, payment gateways, AI platforms, plugins, software vendors, and cloud services.

These services operate under their own terms and policies. We are not responsible for outages, pricing changes, service interruptions, security incidents, or actions taken by third-party providers.

9. AI Services and Automation

Where AI-powered tools, chatbots, automations, or content-generation systems are implemented:

  • Outputs may not always be accurate, complete, or appropriate.
  • Clients are responsible for reviewing and approving AI-generated content and customer-facing communications.
  • We do not guarantee specific business outcomes resulting from AI systems.

10. Website Security and Maintenance

Unless covered by an active maintenance agreement, the client is responsible for ongoing updates, backups, security monitoring, hosting, plugin licensing, and website maintenance after launch.

We are not liable for issues arising from third-party updates, unauthorised modifications, malware, hacking attempts, hosting failures, or expired licences.

11. Warranty

We provide a 30-day warranty following project launch to correct defects directly resulting from our development work.

The warranty does not cover:

  • New feature requests
  • Third-party software issues
  • Hosting problems
  • Changes made by anyone other than Maqam Digital

12. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from any claim shall not exceed the total fees paid by the client for the relevant project.

We shall not be liable for indirect, consequential, incidental, special, or business losses, including loss of profits, revenue, goodwill, data, or business opportunities.

13. Termination

Either party may terminate a project by written notice.

The client remains responsible for payment for all work completed up to the termination date.

Deposits and completed milestone payments are non-refundable.

14. Force Majeure

We shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including internet outages, hosting failures, cyberattacks, natural disasters, government actions, labour disputes, or third-party service interruptions.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
